1. Agreement Overview & Binding Acceptance

By inviting NOIR (hereafter referred to as the "Bot", "Service", "We", or "NOIR") to your Discord Guild (Server), accessing its web dashboard, or executing its commands, you agree to be legally bound by these Terms of Service, our Privacy Policy, and Discord's Developer Terms. If you or your server administrators do not agree with any part of these terms, you must immediately remove the Bot from your guild and cease all interaction.

2. Acceptable Use Policy & Anti-Abuse Rules

You agree to interact with the Bot exclusively for lawful community management and entertainment purposes. You explicitly agree NOT to:

• Deploy self-bots, automated macro scripts, or rapid command loops that intentionally trigger API rate limit lockouts or degrade bot performance for other guilds.
• Use the Bot in servers engaged in, promoting, or organizing server raids, mass spamming, harassment, doxxing, malware distribution, or illegal activities.
• Exploit, manipulate, duplicate, or abuse bugs within virtual economy commands, Love Points, marriage keepsakes, activity leveling XP, or invite counts.
• Attempt to deceive, spoof, or circumvent Vanity status tracking or Official Server Tag tracking using zero-width characters, homoglyphs, or spoofed identity payload injections.
• Reverse-engineer, decompile, copy, extract proprietary algorithms, or redistribute the Bot's source code, branding, or assets without written authorization.
• Impersonate bot developers, support technicians, or affiliates of NOIR or AXORA CLOUD SOLUTIONS™.

3. Anti-Nuke, Auto-Mod & Security Operations Disclaimers

The Anti-Nuke, quarantine, and automated moderation engines are designed to execute defensive counter-measures against unauthorized mass changes (e.g. mass bans, mass channel deletions, mass role modifications):

• Autonomous Security Execution: The Bot acts automatically based upon the sensitivity thresholds, punishment modes, and whitelist configurations defined by your guild administrators.
• Admin Responsibility for Whitelisting: Server owners and administrators bear sole responsibility for maintaining accurate whitelist rosters and granting high-privilege administrative permissions only to verified accounts.
• No Liability for Defensive Actions: We are not liable for unintended member kicks, bans, role removals, or channel reconstructions resulting from misconfigured whitelist limits, false positive thresholds, or compromised administrator tokens.

4. Premium Tier Features, Boost Message & Voluntary Donations

Premium benefits (including Boost Message automation, Join-to-Create voice channels, cryptographic verification captchas, custom profile overrides, and no-prefix command execution) are unlocked via voluntary contributions:

• Server-Bound & Non-Transferable: Premium activations are tied to the specific Discord Guild ID designated upon activation and cannot be resold or transferred without developer authorization.
• Voluntary Contributions: Contributions directly support infrastructure costs, audio node bandwidth, and active development.
• Strict No-Refund Policy: All donations and premium subscriptions are final and non-refundable. Chargebacks or payment dispute attempts will result in immediate and permanent global blacklisting of the user account and associated servers from NOIR.
• Feature Evolution: We reserve the right to refine, balance, add, or optimize premium features to maintain server performance and system stability.

5. Music & Voice Channel Streaming Guidelines

Our music and voice features are provided solely for non-commercial community streaming:

• Content Legality: Users are strictly prohibited from queuing or streaming audio that contains hate speech, illegal material, or unauthorized broadcast streams that violate third-party copyright laws.
• Third-Party Platform Dependency: Playback availability depends on external streaming sources (e.g. YouTube, Spotify, SoundCloud) and Lavalink node connectivity. We do not guarantee uninterrupted streaming if upstream platforms modify their streaming APIs.

6. Virtual Items, Marriage & In-Game Economy Disclaimers

All virtual currencies, Love Points, wedding certificates, boutique gifts, rings, rank XP, and achievement badges are:

• Purely Virtual: Virtual items possess zero real-world monetary, fiat, or cryptocurrency value.
• Non-Exchangeable: Items and points cannot be redeemed, traded, converted, or refunded for real currency, gift cards, or tangible assets.
• Economy Adjustments: We reserve the right to adjust virtual point balances, item prices, or leveling curves to preserve fair competitive balance across the bot ecosystem.

7. Bot Permissions & Role Hierarchy Responsibilities

Proper bot operation depends directly upon Discord's native permission hierarchy:

• Role Positioning: To grant vanity roles, server tag roles, leveling roles, or execute anti-nuke punishments, NOIR's integration role must be positioned higher than the roles it manages in your Server Settings.
• Permission Provisioning: Server administrators are solely responsible for granting required permissions (e.g. Manage Roles, View Audit Log, Manage Channels). We are not responsible for command failures resulting from missing permissions or role hierarchy restrictions.

8. Service Availability & Maintenance (AS-IS SLA)

While NOIR is hosted on dedicated cloud infrastructure provided by AXORA CLOUD SOLUTIONS™with 99.9% target uptime, the Service is delivered on an "AS IS" and "AS AVAILABLE" basis:

• We do not warrant that operation will be error-free, uninterrupted, or fully immune to Discord Gateway rate limits or network latency.
• Scheduled maintenance or critical security patches may cause temporary bot downtime.
• We are not liable for transient message delays, audio disconnects, or database sync lags caused by upstream Discord outages.

9. Termination, Suspension & Blacklisting

Your Rights: You may discontinue using the Bot at any time by kicking or banning it from your server. You can request deletion of your server records by contacting support.

Our Rights:We reserve the full right to suspend, terminate, or permanently blacklist access to the Bot, its commands, and web dashboard for any user or guild found violating these Terms, Discord's Community Guidelines, or attempting to exploit bot infrastructure, without prior notice or refund.

10. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, neither the developers of NOIR, its hosting partners (AXORA CLOUD SOLUTIONS™), nor operational affiliates shall be liable for any direct, indirect, incidental, punitive, or consequential damages (including, without limitation, loss of server members, role deletions, channel wipes, data corruption, or server disruption) arising out of the use or inability to use the Bot.

You agree to indemnify, defend, and hold harmless NOIRand its developers from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your server's use of the Bot, violations of these Terms, or infringement of third-party rights.
